If the rules of conduct re: Photos are set forth in the MTA's enabling legislation...wouldn't a photo ban need to be approved by the state legislature and not the MTA board?

No. The MTA is a private agency that is funded (and therefore influenced) by the State of New York. They don’t need the states approval, but the legislators up in Albany might do a little budget slashing and the MTA will be in deep doo doo. Of course, anything can happen in 40 days.
