NY State allows taping of phone conversations as long as one of the parties being taped knows of it
The problem with wire evidence is that there needs to be some other testomonty as to when the tape was made. If I am carring a recording device in my pocket, and have a conversation with someone, an officer, then *my* testomony of the events is acceptable, and if I make a tape of the event at the time, I can testify to that. And if the officer was talking to both of us, then we are both witneses to what was said, and to the authincity of the recording.
